By way of derogation from these provisions, the application on an area of more than half of the single stretch of forest may be carried out if, in particular cases, the competent authority has, in the framework of the approval according to § 18 (2) PflSchG (Plant Protection Act), established on the basis of a legally binding procedure of ascertainment performed with a sufficient degree of resolution, that on more than half of the single stretch of forest the respective threshold of damage is exceeded and the application of the product is absolutely necessary for the conservation of the concerned area of forest. If this exception clause is applied, the Federal Office of Consumer Protection and Food Safety has to be notified of this fact under specification of the concerned areas and demonstration as to why the prerequisites for the derogation are fulfilled. |

Use in nature reserves is not allowed. By way of derogation from this provision, the application in nature reserves may be carried out in particular cases, if the competent authority, in the framework of the approval according to § 18 (2) PflSchG (Plant Protection Act), has established in agreement with the competent nature conservation authority, that the application is absolutely necessary for the conservation of the plants as defined by the specific purpose of the reserve. If this exception clause is applied, the Federal Office of Consumer Protection and Food Safety has to be notified of this fact under specification of the concerned areas and demonstration as to why the prerequisites for the derogation are fulfilled. |
